Terms of Service

These Terms of Service ("Terms") are an agreement between you and [BUSINESS ENTITY] ("ZipDrop", "we", "us") for use of zipdropapp.com and the ZipDrop service. By subscribing or using the service, you agree to these Terms.

The service

ZipDrop monitors MLS data for the ZIP codes you subscribe to and prepares Instagram carousel post drafts for new listings and listing updates. You review every draft. Nothing is posted unless you approve it.

Subscriptions and billing

  • ZipDrop is sold as a monthly subscription for each ZIP code. Each ZIP is a separate line item on your subscription.
  • Stripe bills your payment method. Subscriptions renew automatically each month.
  • You can cancel at any time. Cancellation takes effect at the end of the current billing period.
  • We do not give refunds for partial months.
  • We may change prices with at least 30 days' notice. The new price applies from your next billing period after the notice period.

Exclusive ZIPs

An exclusive ZIP subscription means we will not sell drafts for that ZIP to another agent while your exclusive subscription is active and paid. Exclusive pricing is shown at checkout. Exclusivity ends if the subscription is canceled, lapses for non-payment, or is terminated under these Terms. Exclusivity covers ZipDrop's service only. It does not restrict other agents' marketing or other services.

Your responsibilities

To use ZipDrop you must:

  • hold an active real estate license in good standing, and keep your California DRE license number accurate in your account;
  • hold your own authorization from your MLS to use its listing data for advertising, and follow your MLS's rules, including attribution and display rules;
  • follow California Department of Real Estate advertising rules, fair-housing laws, and Instagram's Terms of Use and Community Guidelines; and
  • only post listings you are authorized to advertise. You may not use ZipDrop to post listings without authorization.

Approval and posting

You approve every post. When you approve a post, you authorize ZipDrop to publish it on your behalf using Instagram's official API. You are responsible for the content of every post you approve, including its accuracy and compliance with MLS, DRE, fair-housing and Instagram rules. Review each draft carefully before approving it.

No guarantees

We do not guarantee that your MLS board will approve ZipDrop, that MLS data feeds will be available or accurate, or any level of reach, engagement or leads on Instagram.

Disclaimer

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows.

Limitation of liability

To the fullest extent the law allows, ZipDrop's total liability for any claim relating to the service is limited to the fees you paid us in the 3 months before the claim arose. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data.

Termination

We may suspend or terminate your account if you violate these Terms, misuse MLS data, or post content that breaks the law or Instagram's rules. You may cancel at any time as described above.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Santa Clara County, California.

Changes

We may update these Terms. We will update the "Last updated" date and notify subscribers of material changes by email.
